Company ARTIN, spol. s r.o., Id. No. 255 31 115, with its business seat at Purkyňova 670/142, 612 00 Brno, registered in the commercial register kept by Krajský soud v Brně under C 30849 (hereinafter “we”), considers the responsible collection, use and confidentiality of collected personal data to be of the utmost importance for building trust with its customers and partners. We have prepared this overview of the most important aspects of personal data processing so we can provide you with information about how and why we process your personal data, as well as inform you about your rights and the way you can exercise them.

A. Content of this Privacy Policy

Our goal is to make our data processing and this Privacy Policy as transparent as possible. To achieve that, we prepared a brief summary of what is included in this document:

  • our commitment to data security (see Section ‎B);
  • categories of personal data that we process, including examples of personal data (see Section ‎C);
  • purposes for which the processing is being conducted, with corresponding and specified legal basis and defined period of the processing (see Section ‎D);
  • sharing your data with and how (see Section ‎E);
  • your rights regarding the processing of your data and a way how to exercise them (see Section ‎F).

The description of our use of cookies and other tracking technologies is included in our separate Cookies Policy. Whenever we talk about data processing on our website, we also refer to processing in our other online presentations.

B. Our commitment to data security

We are concerned about the security of information. To prevent unauthorized access or disclosure, maintain data accuracy, and ensure the appropriate use of information, we have put in place reasonable technological and managerial procedures to safeguard and secure the information we collect. We use encryption technology when collecting or transferring data.

C. Personal data we collect

In particular, we process data that you yourself have provided to us or that we have obtained from your use of the website, our products or services, your applications and CVs, our communication with us, our meetings and events, etc., as well as data derived from these data.

We are processing personal data that we have divided into several categories:

  • Identification data, such as first name, family name or your title. This data is important for the proper operation of our services and communication with you.
  • Contact details, such as street address, phone number and in particular, an e-mail address. This is necessary for communication with you and operation of some of our services.
  • Other personal details provided by you in your CV and profile (hereinafter “Other personal details”). It is not possible to exhaustively list the personal data we process, as there is no uniform CV template and each of you may voluntarily provide completely different data. As a general rule, the following data is processed: date of birth, photography, area of work, experience, education, citizenship, language skills, courses, training and certificates attended, knowledge and skills, personal interests. We never request personal data that is not necessary for the purpose (e.g. birth number, ID or other card number, copies of documents, etc.). This is necessary for recruitment process.
  • Communication details, i.e. information about communication with you, such as emails, notices from calls etc.
  • Website usage information, i.e. information regarding the traffic on our website and your behavior on our website, such as your IP address, HTTP protocol logs obtained through your computer, phone or tablet used to access the website.
  • Information from cookies, i.e. information from cookies and other tracking technologies we use. For more information on the use of cookies and similar technologies, please see our Cookies Policy.
  • Product and services usage information, i.e. information about the use of our products and services, such as records of access to our product or services, identification of your computer, its IP address or hostname, contain of orders etc.

D. Purposes for data processing

Your personal data may be processed by us as a controller, for the purposes of the processing specified below on the specified legal basis, for a limited period of time and only to a defined extent.

In the first part of this chapter, we describe processing of your data connected with provision of our products or services and recruitment process. In the second part, we describe processing connected with use of our website.

Processing connected with provision of our products or services and with recruitment process

D.1 Provision of our products and services or related information

We may collect personal data required to provide you with our products or services and to interact with you as a customer or customer representative, especially when you:

  • place your order;
  • contact us for help or to get additional information;
  • use our customer support.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Purchase details, Website usage information, Products and services usage information and Communication details.

The legal basis for this data processing is performance of contract between you and us and the necessity to take steps at your request prior to entering into a contract, or if you are not a direct party to this contract, our legitimate interest on performing any concluded contract.

Data are processed for the term of the concluded contract and the fulfillment of the obligations under this contract, or for 3 years from the collection of the data, if no contract is concluded.

D.2 Recruitment process

We may collect personal data required to evaluating the job applicants and the recruitment process, especially when you:

  • send us your CV or application for a job;
  • attend our meetings or events.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Other personal details and Communication details.

The legal basis for this data processing is our legitimate interest in evaluating the job applicants and the recruitment process in our firm.

Data are processed for 2 year from the moment we obtain your CV or application for employment, after the expiry of the period, we may ask you for your consent. You may, however, give us your consent even before the expiry of this period.

Data are processed for 2 years from the moment we obtained your consent with data processing for the purpose of the future recruitment process.

D.3 Protection from piracy and unauthorized use of our products and services

We may process your personal data in order to protect ourselves from piracy and unauthorized and unlawful use of our products and services in order to ensure the safe use of our services.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Website usage information, Products and services usage information where applicable and Communication details.

The legal basis for this data processing is our legitimate interest in protection from piracy and unauthorized use of our products and services.

Data are processed for a maximum of 10 years after termination of the concluded contract or for 3 years from the collection of the data, if no contract is concluded.

D.4 Improvement of our products and services

We may process personal data on how you use our products and services, what functionality you use the most etc., so that we can better understand and follow the trends in the development of the use of these products and services, so we can improve and further develop them to your satisfaction.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Website usage information, Products, and services usage information, and Communication details.

The legal basis for this data processing is our legitimate interest in improving our products and services. Data are processed for a maximum period of 3 years.

D.5 Internal evidence, statistics and protection of our rights and interests

We may process your personal data in order to protect our legal claims in general. We may also use your data for the purposes of generating statistical reports or records to have evidence that a payment has been made for the products and services or that you only have access to a particular product or service for a certain period of time, or that you can try our products and services just for a limited time.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Other personal details, Website usage information, Products, and services usage information, Purchase details, and Communication details.

The legal basis for this data processing is our legitimate interest in the protection of our legal claims. Data are processed for a maximum of 16 years after termination of the concluded contract with you.

D.6 Promotion and marketing of our products, services, recruitment process, meetings, and events

We may use data you provided throughout the evaluation, registration or purchase of our products and services, the contact form, the job-application, at our meetings and events which you attended, to inform you of our products and services and send you news about the product or service, new version announcements, service alerts, newsletters, thanks for your attending the meeting or event, inform you about next meetings or events or job offers.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Other personal details, Website usage information, Products and services usage information; and Communication details.

The legal basis for this data processing is our legitimate interest in promotion of our products, services, meetings, events and job offers. Data are processed for a maximum of 6 months after termination of the concluded contract with you.

If we process those data based on you consent, they are processed for 5 years from the moment we obtained your consent with data processing for the purpose of promotion and marketing.

Other than objecting to the processing for marketing purposes (see F.7), you can anytime opt-out of receiving any newsletters using unsubscribe links provided in the footer of each message, and in such case we will withdraw from all processing under this section.

D.7 Fulfillment of legal duties

We may also process your personal data in order to fulfill the legal obligations that apply to us, especially in the tax area. We also need to be ready to cooperate with public authorities if required by law.

The following categories of personal data are processed for this purpose: Identification data, Contact details, Website usage information, Purchase details, Products and services usage information and Communication details.

The legal basis for this data processing is our compliance with our legal obligations. Data are processed for the periods determined by the law.

Processing connected with usage of website

D.8 Operation of the website and its security

We process your Website usage information and Information from cookies, which are necessary for operation of website, including presentation, functionality of the website and ensuring your safety. Within this purpose, we identify you as a visitor during the web browsing or during repeated logins on our website. The legal basis for such processing is our legitimate interest on due functionality and operation of our website.

We generally retain your personal data for up to 2 years after yours visit to our website.

D.9 Customization of website (preferences)

We process your Website usage information to keep your preferences and customize website. We can than simplify browsing of the website for you. For this purpose, we customize website – location, language choices and your device to your preferences. The legal basis for processing Information about usage of website is our legitimate interest on customization of website to preferences of customers.  We generally retain your personal data for up to 2 years after your visit of our website.

With your consent, we also process Information from cookies, which are necessary for customization of website (preferential cookies), while your data may also be transferred to third parties. The legal basis for processing here is therefore your consent, given through the Cookies Sidebar. We retain your data for the duration of your consent but in any case, no longer than 2 years from receiving your consent.

D.10 Analysis of visits of website (analytics)

Our processing of your Website usage information is necessary for understanding the way in which visitors use our website. Within this purpose, we monitor traffic on our website, optimize our website, ensure the security of your data and make the website more seamless and user-friendly. The legal basis for processing information about usage of website is our legitimate interest on gathering information about usage of our web for its further improvement. We generally retain your personal data for up to 2 years after yours visit of our website.

With your consent, we also process Information from cookies, which is necessary for analysis of visits of our website (statistical analytical cookies), while your data may also be transferred to third parties. We process your data based on your consent, which you gave to us through the Cookies Sidebar. We retain your data for the duration of your consent but in any case, no longer than 2 years from receiving your consent.

D.11 Promotion and marketing on our website (marketing)

We process your Website usage information as necessary to gather information about your personal preferences to show relevant advertisement. Within this purpose, we promote and market products and services, meetings and events and job offers on the website and show you marketing communication related to products and services, meetings and events or job offers you expressed your interest in and promote our brand through online promotion. The legal basis for processing information about usage of website is our legitimate interest on promotion of the sale of our products and services, of our meetings and events and job offers. We generally retain your personal data for up to 2 years after yours visit to our website.

With your consent, we also process Information from cookies, which are necessary for targeting and showing our advertisement (marketing cookies), while your data may also be transferred to third parties. The legal basis for processing here is therefore your consent, given through the Cookies Sidebar. We retain your data for the duration of your consent but in any case, no longer than 2 years from receiving your consent.

E. Sharing of your data

We are the data controller. This means that we determine the above-defined purposes for which we collect your personal data, specify the processing of your data and are responsible for its proper performance.

We may share your personal data with certain third parties. They mostly help us provide you with our products and services. They act as a data processors and will not use any of your personal data for other purposes than for the above mentioned. Currently there is no such third party.

Your personal data may also be shared with other entities, such as social networks, if we have obtained your consent to do so.

We may share your personal data with certain third parties that acts as other controllers if we are obliged to share them under applicable legislation (especially with tax authorities or with other government bodies exercising their statutory powers) or if such sharing of your personal data is necessary to achieve the purposes defined above, especially the purpose of "Fulfilment" of legal duties (for example with government bodies or with parties harmed by your illegal acts, if applicable).

We may also share your personal data with third parties acting as data controllers who help us process your payments, as described within the purpose “Provision of our products and services or related information”.

If we share your personal data to processors or controllers in the third countries, we do so only if there is a decision from the European Commission that a certain country outside the EU/EEA ensures an adequate level of protection, including where the processors or controllers have taken appropriate protection measures, for example Binding Corporate Rules (BCR) or Standard Contractual Clauses (SCC).

We will not sell, give or share any personal data to any other third party processor, or for any purpose not specified in this Privacy Policy.

F. Your rights connected with processing

We have some specific rights and obligations when we process your personal data as a data controller, but you have some rights as well. You may have the right to: (i) request access to your personal data; (ii) withdraw your consent; (iii) request rectification of your personal data; (iv) request erasure of your personal data; (v) request a restriction on the processing of your personal data; (vi) request personal data portability; (vii) object to the processing of your personal data; or (viii) file a complaint.

In all matters relating to the processing of your personal data, whether it be a question, the exercise of rights, filing a complaint, or anything else, you can contact us by email at artin@artin.cz.

Your request will be processed without undue delay but within a maximum period of one month. In exceptional cases, especially due to the complexity of your request, we are entitled to extend this period by another two months. We will, of course, inform you of any such extension and its justification.

Further, you have a right to file a complaint to the data protection authority, as described below.

F.1 Right of access

You may have the right to obtain from us a confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, to request access to your personal data.

The information about personal data processing includes the purposes and scope of the processing, the recipients of the data, the duration of the processing, the right to rectification, erasure, restriction on processing and objection to processing, the right to fill a complaint with a supervisory authority and the sources of the personal data (this information is already provided in this document).

Further, you may have the right to obtain a copy of your personal data undergoing processing. For additional copies requested, we may charge a reasonable fee based on administrative costs.

F.2 Right to withdraw your consent

You may have the right to withdraw your consent given to us for some specific purposes at any time. You can do this on our website or by contacting us. However, withdrawal of consent does not affect the lawfulness of data processing prior such withdrawal.

F.3 Right to rectification

You may have the right to obtain from us the rectification of inaccurate personal data. Depending on the purposes of the processing, you may have the right to have incomplete personal data made complete, in particular by providing a supplementary statement.

F.4 Right to erasure (right to be forgotten)

You have the right to have your private data erased in cases where:

We no longer need your personal data for the purposes for which we collected or processed it,

  • you withdraw the consent on the basis of which the personal data was processed and there is no further reason for processing it;
  • you object to processing and there are no other overriding reasons for processing, or you object to processing for direct marketing purposes;
  • the personal data are processed in breach of the law.       

However, you cannot exercise this right if the processing is necessary for compliance with our legal obligations or for the performance of tasks entrusted to us in the public interest or for the establishment, exercise or defense of legal claims.

F.5 Right to a restriction on processing

You may exercise the right to restriction on processing of personal data in following cases:

  • you contest the accuracy of your personal data; in this case, you may request a restriction on processing until the accuracy of the personal data has been verified;
  • the processing is contrary to the law and you request restriction on the processing of your personal data instead of erasure;
  • we no longer need your personal data for the purposes for which it was collected or processed, but you require it for the establishment, exercise or defense of legal claims;
  • you have objected to the processing of your personal data; in this case, you may request a restriction of processing pending verification that our legitimate interests prevail.

F.6 Right to personal data portability

You have the right to obtain a copy of your personal data that we process by automated means on the basis of your consent or for the performance of a contract. We will transmit this data in a commonly used and machine-readable format to you or to a controller designated by you, if technically feasible. The scope of the data provided may be limited so as not to interfere with the rights and freedoms of others.

F.7 Right to object

You have the right to object to the processing of your personal data that we process on the basis of our legitimate interest. We will stop processing your data if there are no other overriding reasons for processing or if the processing is not necessary for the establishment, exercise or defense of legal claims or if you object to processing for direct marketing purposes.

F.8 Filing a complaint

Furthermore, you may file a complaint related to the processing of your personal data with the competent data protection supervisory authority, i.e. our case with the authority of our main establishment in the Czech Republic the Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7, Czech Republic.

F.9 Changes to this Privacy Policy

This Privacy Policy is current as of 26.3.2024. We may change this Privacy Policy from time to time, so please be sure to check back periodically. We will post any changes to this Privacy Policy on our website.
